Notice of Privacy Rights
In accordance with the Health Insurance Portability and Accountability Act (HIPAA), Dr. Holbert and Associates will assure the confidentiality of a patient's protected health information, including personal information provided by the patient and health information received or established by Dr. Holbert and Associates through treatment, payment, and other healthcare operations.
HIPAA protects a patient's right to adequate uses and disclosures of their protected health information in most cases. To avoid interfering with a patient's access to quality health care, HIPAA permits Dr Holbert and Associates, without a patient's written consent, to use and disclose protected health information in the following cases:
Treatment:
Private health information may be used or disclosed to other health care providers within and outside our practice providing treatment to the patient. This includes information disclosed during consultation between healthcare providers, including vendors (optical laboratories and frame and contact lens manufacturers), regarding a patient, or the referral of a patient from Dr. Holbert and Associates to another healthcare provider. In cases where the patient is a minor or dependent, private health information may be used or disclosed to the patient's legal guardian.
Payment or other financial arrangements:
Private health information may be used or disclosed during the various activities necessary to obtain payment or reimbursement for services rendered by Dr. Holbert and Associates. Such activities include, but are not limited to, determining insurance eligibility or coverage and claims for payment. In cases where the patient is a minor or dependent, private health information may be disclosed to the persons responsible for arranging payment.
Healthcare operations:
Private health information may be used or disclosed in matters pertaining to administrative activities that are necessary for Dr. Holbert and Associates to support the core functions of treatment and payment so as to adequately run business. Healthcare operations include quality assessment and improvement activities such as conducting or arranging for medical review, legal, and auditing services, as well as business planning, development, and management. This includes, but is not limited to, miscellaneous activities such as using personal information via phone, e-mail, or letter for patient notification and reminders of appointments and the arrival of optical materials.
HIPAA will require a patient's written authorization for use and disclosure of private health information in any other manner than as previously described. A patient may also submit a written request for restrictions on how and to whom Dr. Holbert and Associates may use and disclose information about them for treatment, payment, or health care operations. HIPAA allows Dr.Holbert and Associates to reserve the right to refuse a patient's request, but once a request is accepted Dr. Holbert and Associates are obliged to any restrictions to which we agree.
Dr. Holbert and Associates is required by law to abide the terms of this notice as it is currently stated, and reserve the right to change it provided the new notice will not be in effect until posted or available in the our office.
